[VIDEO] Tax Law Whistleblower Claims on the Rise
Bloomberg Law’s Spencer Mazyck talks to Jack Trachtenberg (Sutherland Asbill & Brennan) about the growing trend of taxation-related whistleblower lawsuits claiming violations of the False Claims Act (FCA). According to Trachtenberg, these FCA tax suits expose businesses to new risks:
• Treble damages: a potential for fines equaling three times the tax in dispute plus penalties
• Reputational risks arising from bad publicity
• Loss of confidentiality because claims are disputed in public courtrooms instead of tax tribunals
